I'm not sure why you should only get CVCC kill points if you attack...

I think we can assume that if in general (not vs. a certain company) you can initiate CvCC, then you will get kill MPs from CvCC. Otherwise a minion company getting attacked by a hero company at Rivendell couldn't get MPs either, since they can't initiate CvCC there against that company.
From what I understand, defenders also get the kill points. The "If you can initiate..." ruling you mentioned was trying to simplify questions about who can initiate CvCC vs. who can get points from it. It had nothing to do with defenders and kill points.
